好消息!美国务院公告:留学生直系亲属可以直飞美国!

5月13日,美国国务院发布通知,允许符合条件的来自中国等地的学生、访问学者等直系家属获得国家利益豁免(NIE)资格,无需第三国14天隔离即可直接赴美。该公告是对4月26日美国国务院豁免中国留学生/访问学者直接入境美国政策的进一步明确。

4月26日,美国国务院正式解除对来自中国、伊朗、巴西、南非、申根签证国、英国和爱尔兰等地F、J、M等签证持有人的14天旅行禁令,来自这些地区的持有上述签证的人员可直接入境美国,其中包括留学生、访问学者和记者等。


这项美国国务院新的通知是对4月26日政策的补充。包括中国等地留学生和访问学者直系家属也获得美国国家利益豁免(NIE)资格,这意味着留学生的配偶、子女作为直系亲属不再受14天入境隔离政策限制,可以直接赴美!注意,直系亲属不包括但是不包括父母、兄弟姐妹等其他亲属。

在最新豁免行列里,不仅包括持有效F-1和M-1签证的学生,还包括OPT(选择性实践培训)在内。


符合条件的这类持签证学生,将不再需要另联系大使馆或领事馆,可在课程开始前30天内直接赴美(最早赴美时间为7月2日)。


此外,符合条件的陪同家属也同样适用于这次豁免行列。


值得注意的是,由于只是通知,具体的入境美国的材料要求和实施细节可以关注美国国务院官网、美驻华使领馆或者学校官网的通知。


根据5月13日的公告,留学生/访问学者的附属家属-配偶和子女可以直接入境,留学生父母还须绕道第三国14天才能入境美国。同时,该公告也明确了持有留学签证以及OPT身份的学生,也可以直飞入境美国。


National Interest Exceptions for Certain Travelers from China, Iran, Brazil, South Africa, Schengen Area, United Kingdom, and Ireland

On April 26, 2021, the Secretary of State made a national interest determination regarding categories of travelers to be excepted from Presidential Proclamations (PPs) 9984, 9992, and 10143 related to the spread of COVID-19.  As a result of this determination, together with national interest determinations already in place, travelers subject to these proclamations, due to their presence in China, Iran, Brazil, South Africa, the Schengen area, the United Kingdom, and Ireland, who are seeking to provide vital support for critical infrastructure; journalists; and students and certain academics covered by exchange visitor programs, among others, may now qualify for a National Interest Exception (NIE).


Students and academics subject to these proclamations due to their presence in China, Iran, Brazil, or South Africa may qualify for an NIE only if their academic program begins August 1, 2021 or later. Derivative family members accompanying a noncitizen who has been granted or would be reasonably expected to receive an NIE  and who is engaging in certain types of long-term employment, studies, or research lasting four weeks or more are also excepted.  Qualified travelers who are applying for or have valid visas or ESTA authorization may travel to the United States following the procedures below.


Students with valid F-1 and M-1 visas intending to begin or continue an academic program, including optional practical training (OPT), starting August 1, 2021 or later do not need to contact an embassy or consulate to travel.  They may enter the United States no earlier than 30 days before the start of their academic program.  Students seeking to apply for new F-1 or M-1 visas should check the status of visa services at the nearest embassy or consulate; those applicants who are found to be otherwise qualified for an F-1 or M-1 visa will automatically be considered for an NIE to travel.


Travelers in categories described above who have a valid visa or who have a valid ESTA authorization should contact the nearest U.S. embassy or consulate before traveling if they believe they may qualify for an NIE. If an NIE is approved, they may travel on either a valid visa or ESTA authorization, as appropriate.


The Department of State also continues to grant NIEs for qualified travelers seeking to enter the United States for purposes related to humanitarian travel, public health response, and national security.  These travelers and any others who believe their travel to be in the United States’ national interest should also review the website of the nearest U.S. embassy or consulate for instruction on how to contact them.


As with all NIEs for qualified travelers seeking to enter the United States under a Presidential Proclamation, if circumstances warrant, the Secretary of State may revise the national interest determination.
